经济法的价值本位探究

Research on Value-based Economic Law

Economic Law is an emerging department law. Its emergence is inherently inevitable and objective with historical origin. At the beginning, it is with the feature of mandatory intervention. ＂Market failure＂ is the theoretical basis for state intervention. It appears as the mandatory means of power of the state. The basic value and aim of it lie in safeguarding social and public interests and people＇ s basic rights. And its basic principles include safeguarding fair competition, carrying out macro-control, and realizing the overall unity of social fairness and efficiency.
