| 摘 要： | 超期羁押的本质就是非法拘禁 ,而之所以屡禁不止 ,已远不是办案机关办案人员个体的观念意识问题 ,而涉及法律制度本身乃至整个国家的诉讼价值和法治观念问题。解决超期羁押问题需要从基本法治观念到具体制度设计的彻底反思。

| Abstract: | The extended custody is by nature an unlawful detention, which frequently happens irrespective of its being forbidden. It is concerned with not only the idea of some individual who handles a case but legal system itself, even with the actionable value and the entire concepts of legality in a state. The resolution of the extended custody needs comprehensive reflection from the fundamental legal idea to legislation of the substantive legal regulation. |
