| 摘 要： | 我国2001年《著作权法》在第11条与第16条中分别对法人作品与职务作品的著作权归属作出了相关规定。但此种规定在实践中暴露出诸多不足，其中包括对两类作品划分的困难，著作权归属的争议以及对著作权人保护的不周。为此，可从两大法系对相关问题的规范入手，探寻产生上述问题的根源，并提出解决方案。
