| 摘 要： | 刑法典第三百五十六条实质上是关于特别累犯的规定。该条规定存在三个方面的立法缺陷:一是构成毒品累犯的前罪范围过于狭窄,二是构成毒品累犯的时间条件过于宽松,三是规定在刑法典分则中不合适。针对这些缺陷,笔者相应地提出了立法完善意见。

| Abstract: | Essentially, Article 356 Of Penal Code stipulates special recidivist. There are three shortcomings in this article, first, the range of the former crime which meets the demand of special recidivist is too narrow; second, the time interval of the former crime and the present crime is too long; and third, it is unsuitable to stipulate special recidivist in the subprovision of Penal Code. According to these shortcomings, the author puts forward several proposals to improve this article. |
