近代中国移植日本银行法论略

1872年日本开始了银行法律体系的建设，其对近代中国产生了重大影响。近代中国银行法在立法思想、法律体例、法律适用等方面处处可见日本法的因素。通过移植而建的银行法实现了形式上的现代化，促进了中国法制的现代转型。但同时也存在立法超前、脱离实践等弊端。近代约四十年的立法进程，为当代金融法律体系的移植与构建提供了历史经验与借鉴。

On the Legislative Transformation of Japanese Banking Laws in Modern China

Since 1872 ,Japan started the development of banking legal system. It had a major impact on modern China, such as legislation thought, legal style, the law applies. Through the transplant of banking laws, modern China achieved modernization and promoted the transformation of China＇ s legal system. But there are also defects, such as legislative ahead, out of practice and so on. About four decades of modern legislative process provided experiences of the contemporary financial legal system and the construction of the transplant.
