| 摘 要： | 刑事案件中的假象具有如下基本特性:预谋性、必然性、多样性,识别假象的方法主要有:1 从反常现象中发现疑点;2 利用现场环境和遗留痕迹分析识别;3 从作案活动是否符合作案一般规律进行识别;4 依据事实自述与现场态势比较识别;5 运用科技手段检验识别。

| Abstract: | The false appearance in the criminal cases has the following characteristics:premeditation quality,certainty,variety.There are several means to discern it.First,finding the doubtful points from the abnormal phenomenon;second,utilizing on-the-spot environment and left mark to analyse and discern;Third,discerning whether the crime activity accords with the universal law;Fourth,making relative discern according to the account in one's own words of victim of a crime and on-the-spot situation;the last,examining and discerning by scientific and technological means. |
