“伪造空白信用卡”行为的刑法分析

通过《中华人民共和国刑法修正案(五)》,我国刑法对于涉及信用卡的犯罪规定有较大的修改和补充。对于伪造信用卡的伪造行为、使用行为、持有、运输等一系列行为都作了规定,但是,对于伪造空白信用卡的行为却态度不明。出罪还是入罪?在持有、运输伪造的空白信用卡都可能构成犯罪的情况下,伪造空白信用卡理应入罪。在没有刑法明文规定的前提下,入罪有违罪刑法定原则。

Criminal Analysis of the Offense of Forging Blank Credit Cards

The Fifth Amendment to the Criminal Law of the People＇s Republic of China has made,many modifications and supplements on credit card crime.There have been regulations about the activities of forging,using,possessing and transporting forged credit cards except forging blank credit cards. Because possessing and transporting forged blank credit cards can constitute a crime,forging blank credit cards should be criminalized.However,criminalization may violate the principle of crimes and punishment stipulated by law for lack of specific regulations.
