摘    要:1986年《土地管理法》颁行后经1988年、1998年、2004年三次修改,都没有将土地承包经营权作为登记的对象;这与《农村土地承包法》、《物权法》以及《不动产登记暂行条例》的规定相冲突,与经济体制改革中我国农村经营体制发生巨大转变的状况不相适应;应当及时修改现行《土地管理法》第11条规定,将土地承包经营权纳入农用地登记范围,以保持我国法律体系统一性,维护集体农民的权利义务一致性。

Abstract:In 1986 the Land Administration Law enacted, and it has three amendments in 1988, 1999 and 2004 with no mention of the rural land contracting rights as registrable properties, which contradicts rel-evant provisions in the Rural Land Contracting Law, the Property Law as well as the Interim Real Property Registration Ordinance. Such ignorance by the Land Administration Law does not reflect the already changed economic system in Rural China. The paper argues that Article 11 of the Land Administration Law shall be amended immediately to include rural land contracting rights as registrable properties for the unity of our legal system and the better protection of the interests of collective farmers in rural China.
