论中国法律传统的现代价值

中国土地物权、行政、司法等传统法律制度均有其重要的现代价值。“一田二主”制曾在中国历史上长期盛行，时值今日仍有其现实的生命力。整个中国封建时代的行政管理体制都有“理性行政”的特色，近代西方将其引入并改造为通行西方世界的文官制度。目前在西方兴起的“恢复性司法”运动，在价值理念上与儒家的和谐思想与调解制度有诸多近似之处，封中国今天构建和谐社会均有借鉴意义。
