论我国国有土地使用权制度

摘    要:土地制度是一个社会的重要财产制度,我国为发挥市场机制对土地资源的调节作用,以提高国有土地的利用效率,因而创立了国有土地使用权出让制度,其目的就在于以土地使用权代替和发挥土地所有权的作用和功能。但是该项土地使用权制度最大的不足就是对土地使用权的期限设定了限制,从而损害了市场作用的发挥和损害了公民的财产安全,因此有必要取消土地使用权的期限限制,将国有土地所有权的概念政治化或虚拟化。

Abstract:Land system is one of important social property systems in China.In order to bring into play the regulating power of mar-ket mechanism to land resources so as to increase the utilization of state- owned land, the Use Right Transfer System of State- ownedLand was formulated.The purpose of this system is to replace the effect and function of Land Ownership with Land- use Right.Butone of weaknesses of this system is that restriction has been imposed on the right to use land by setting a term of validity, there-fore the market regulating function can not put into full play and the property safety of the citizen will be impaired.The authorholds the view that the term of validiy of land- use right should be abolished and the concept of land stateownership should be po-liticalized or desubstantiated.
