试论农村居民人身损害的平等求偿权

本文以两个典型案例作为切入点,分析阐述了我国现行法律关于人身损害赔偿的规定中存在着城乡二元标准,而以户籍为依据的二元赔偿标准是典型的身份歧视,应予取消。城乡居民人身损害赔偿应一视同仁,在建设社会主义新农村的大背景下,农民的这一底线权利应得到法律的保障。

Rural Residents Should Have Equal Rights to Compensation for Personal Injuries

With two typical cases as the cutting point, this article makes an analysis of two different standards stipulated in our current law concerning personal injuries, one applied to urban residents and the other to rural residents. The different compensation standards based on household registration show obvious discrimination against rural residents and therefore should be put an end to. Rural residents should have the same standard of compensation for personal injuries as urban residents. This most basic right of rural residents should be legally protected against the background of the on-going construction of a new socialist countryside.
