| 摘 要： | 道路交通安全法上的"违法行为人"既是道路交通行政法律关系的相对人又是行政责任的承担者。笔者认为,我们应该从"违法行为人"与行政法中的行政相对人的关系、"违法行为人"的行为能力、责任主体范围和具体的行政责任形式等方面的探讨来丰富和完善相应的法律法规体系。

| Abstract: | Law-breakers in road traffic safety law refer to not only the counterparts of road traffic administrative laws but also the undertakers of administrative liability. We had better enrich and improve corresponding laws and regulations system from the relationship between law-breaker and the administrative counterpart of administrative law, Law-breaker＇s capacity, the scope of liability body, svecific administrative liabilitv form etc. |
