| 摘 要： | “公开审判”是我国宪法规定的基本原则，并在三大诉讼法中也得到确立。但是在立法和司法实践中，存在着不当限制和过度运用该原则的倾向。我们应当在我国司法现状下深层次把握该原则，找到运用公开审判原则的“黄金分割点”，从而构建该原则下的具体制度，使其发挥其最佳作用。

| Abstract: | Open trialis a basic principle stipulated by our country Constitution,and has been established in the three procedural laws.However,tendency of improper limiting and excessive application of the principle exist in the practice of legislation and jurisdiction.We should deeply understand it under the current situation of our country's jurisdiction,and find the golden section ratio of the principle ofopen trial,thus to construct its concrete systems and make the best use of it. |
