有错必纠与行政行为的不可变更力

在行政执法实践中,经常有行政机关以自我纠错为由,对多年前做出的行政行为予以撤销。这对行政机关而言,是履行自我监督的职责;但对行政相对人而言,撤销早已生效的行政行为,会对其现有的生活秩序造成影响。在理论上,行政机关的自我纠错与行政行为的不可变更力理论更是一对矛盾。
