| 摘 要： | 立法委员申请宪法解释程序的法定要件分为:申请主体、申请条件和解释对象.在界定这些法定要件时,是否考虑申请主体的主观利益、政治立场?台湾地区在将德国宪法解释制度移植于本土法治环境时,对于上述问题都产生了很大的分歧和争议,而这些分歧与争议主要源自对宪法解释程序功能定位的困惑,而这一困惑又源自于违宪审查永恒的难题,政治与法律的界分.
