片面共同犯罪理论是刑法理论界争议较大的一个概念。立足于主客观相统一的基本立场,坚持罪刑法定的基本原则,较为系统的梳理了片面共犯的理论源起、学说争议,分析了片面共犯的性质,界定了片面共犯的概念、构成。在阐释共同犯罪本质的基础上,对片面共犯的处罚根据、责任分担进行再定位。

On one-sided joint crime theory

One-sided joint crime theory is a controversial concept in criminal law circles.This study is based on the basic position of subjective and objective unity,and by adhering to the basic principles of legality(nulla poena sine lege),a systematic review is thus taken to explore the theoretical origins of the one-sided accomplice,the doctrine dispute,analysis of the nature of one-sided accomplice,and the definition of the concept of one-sided accomplice as well as its constitution.On the basis of interpreting the nature of a joint crime,the punishment of the one-sided accomplice and shared responsibility are thus repositioned.
