企业环境责任确立的正当性分析——以可持续发展理念为视角

随着环境危机的日益严重,由于科技水平有限性和科学不确定性的普遍存在,应该在环境法中确立企业环境责任。作为企业社会责任的组成部分,企业环境责任包括企业环境法律责任和企业环境道德责任。可持续发展理念蕴涵的经济目标和环境目标共存的思想决定了企业环境责任的确立必须以可持续发展理念作为价值导引。由于目前立法中的企业环境侵权责任在保护社会公众环境利益方面越来越显得力不从心,因此从企业环境侵权责任走向企业环境责任应该成为必然。

Justification of the Establishment of Company's Environment Responsibility

It is necessary to establish company's environment responsibility since environmental crisis is more and more harsh and the development of science and technology is limited and uncertain.As a component of company's social responsibility, company's environment responsibility includes legal aspect and moral aspect.The idea of co-existence of economic and environmental aims in the notion of sustainable development means the establishment of company's environment responsibility should be guided by the notion of sustainable development.The legislation now for company's liability on environmental tort is not enough to protect public's environmental interest,therefore it is necessary to shift company's liability on environmental tort to company's environment responsibility.
