| 摘 要： | 经济犯罪不适用死刑或严格适用死刑,已是各国的通行做法。像中国这样死刑大量适用于经济犯罪的情况实属罕见。对经济犯罪适用死刑有违刑罚的正当性、功利性和人道性的要求。因而,对经济犯罪取消死刑,代之以资格刑和财产刑,更符合世界立法趋势。
