| 摘 要： | 将民主讨论的过程及其效果置于特定语境之中,并引入到“社会诉讼”的分析手段中解读,可以发现法律议论的型构过程是复线并动态互构的,理想逻辑与社会伦理的讨论场景下的博弈效果呈现非均质的状态,并以对话方式走向沟通与共识。

| Abstract: | Placing the process and result of democratic discussion into the specific context and explaining them by the analytic approach of "social action",we can find that the forming process of law discourse is reciprocal and dynamic,and that the game result in the context of ideal logic and social ethics is non-homogeneous. |
