| 摘 要： | 与传统民法理论相比,我国代位权行使范围及效果归属作出了变通规定。本文通过对两种理论的比较研究,认为我国的变通规定与代位权制度的设立目的、逻辑体系甚至法律的公平正义精神均有不符。因此,在将来制定民法典时,应采纳传统民法的代位权制度。

| Abstract: | Compared with the theory of traditional civil law,there are many rules of modification about the enforcement scope and effectiveness attributing of subrogation.The author argues all of these changes do not confirm with the intent of formation and logical system of subrogation,even with the spirit of equity and justice of law.Thus,the system of subrogation in traditional civil law should be adopted in the Civil Code to be come in China. |
