| 摘 要： | 国家赔偿法的实施，有效地保障了公民的基本人权，及时地弥补了公民因国家机关侵权而遭受的物质损失，慰抚了他们受伤的心灵，同时从法律上规范了行政机关和司法机关依法行政、依法司法的行为，提高了他们自觉执法、严格执法的水平和能力，良化了国家和政府的形象，密切了政府和人民群众的关系。开展国家刑事赔偿制度的课题研究，认真分析国家刑事赔偿制度存在的问题及其原因，并采取相应办法改良我国国家刑事赔偿制度是当务之急。
