| 摘 要： | 为有效利用法院调解制度并促进制度自身的完善,法院调解的正当性评估是有必要的,其正当性基础是自愿原则。评估可以从双方合意解决纠纷和纠纷解决过程中的法院协助两方面进行。

| Abstract: | It is requisite to make an appraisal of court mediatory ligitimation for purpose of imposing upon court mediatory institution and making itself completed.Taking the principle of free will as legitimate basis,the appraisal can be operated from the two parties' mutual agreement to settle disputes and disputes settlement through court associate agency. |
