检察业务机构设置研究

检察业务机构虽经多次调整,但机构重叠、职能交叉、结构不严、效率不高等问题尚未从根本上解决.应本着整体强化、协调发展、优化组合、精简效能的原则对检察业务机构进行改革,将目前反贪、反渎、预防、控告、侦查监督、公诉、民行检察、监所检察等八个主要业务部门,按照法律监督三项基本职能进行机构和职权调整.构建三个副院级的二级机构,即反贪局、公诉局、诉讼监督局的检察业务机构设置模式.

On the Setup of Procuratorial Working Departments

Adjustment time after time of the procuratorial working departments has not radically resolved the problems of setup superposition, function interference, structural imprecision and low efficiency. The procuratorial working departments should be reformed under the principles of integrated consolidating, harmonious developing, optimized combining, and condensing efficiency, and current eight working departments, which are anti-corruption, anti-malfeasance, official crime prevention, complaint, investigation supervision, public prosecution, civil and administrative prosecution, and prison supervision, should be regulated regarding the organization and function according to three basic functions of legal supervision. A pattern of procuratorial working departments should be established to reconstruct three secondary bureaus of anti-corruption, public prosecution and procedural supervision under each procuratorate.
