| 摘 要： | 目前,中国理论界、实务界和国家相关政策法规在反租倒包上存在“支持说”与“反对说”两种观点。该文提出,反租倒包是制度创新的产物,是农民意思自治的成果,没有损害农民的流转主体地位和承包权益,亦未违背《农村土地承包法》等相关法律的规定。应尊重农民的创造权,完善相关的法律法规,赋予反租倒包应有的法律地位。
