形象权探析

摘    要:综合形象利益的经济因素和人格因素,形象权指民事主体对表征其独特人格特征具有可指示的形象利益(肖像、形体、声音等)享有的利益并排斥他人侵害的具体人格权。形象权与肖像权具有同构性,在人格权体系下建议取消肖像权,取而代之以形象权。形象权包括精神性利益和财产性利益。

Abstract:Synthesizing the economic and personality factor,the right to publicity refers that the civil subject repulse others' any invasions and enjoy the interests of denotable publicity which characterizes the specific personality including image,physical shape,sound and so on.As the right to publicity and the right to image are isomorphic,the author suggests to replace the right to image with the right to publicity.The right to publicity includes spirituality interests and property interests.
