“黑社会性质组织“之辨析

黑社会性质组织是1997年修订的刑法新创制的法律名词,认定某犯罪集团是不是黑社会性质组织,最关键的是看其是否完全具备“在一定区域或者行业范围内以暴力、威胁、滋扰等手段,大肆进行敲诈勒索、欺行霸市、聚众斗殴、寻衅滋事、故意伤害等违法犯罪活动,严重破坏经济、社会生活秩序”这一属性特征。黑社会性质组织已具备了黑社会组织犯罪的基本特征,从本质来看,应该属于黑社会组织范畴。黑社会性质组织是高级的有组织犯罪集团,从渊源和属性上看,我国黑社会性质组织主要是由既相区别又有联系的流氓恶势力和帮会组织构成。

Discrimination of Criminal Organizations

Criminal organization is a law concept formulated by the criminal law revised in 1997. The key to identifying a criminal organization is to decide whether it has such a feature that in a certain area or a sphere of activity, it commits some crimes, including extorting by blackmail, riding roughshod over the market, gathering mobs to have brawls , stirring up quarrels and trouble, doing injuries intentionally,etc. ,which destroy the ecnomic and social order.The criminal organization has been gangland criminal syndicate. From the aspect of source and attribute, Chinese criminal organizations are mainly composed of the different but related gangs of hoodlums and secret societies.
