工会法人依法可独立享有民事权利,承担民事义务,既具有法人共有的民事权利,也具有自己特有的民事权利,即为实现工会维护职工权益之特有宗旨所需要的民事权利,主要包括代表权和监督权。但工会法人不应具有从事营利性活动的权利。
