行政复议答辩书写作新探

随着《行政复议法》的施行和《行政复议条例》的废止，行政复议答辩书的制作与要求也随之产生变化，表现在制作前提条件的不同，是否为必备文书的不同，以及制作该文书的法律责任的不同。该文书的答辩理由主要采用反驳的方法，同时也有别于一审行政答辩状的答辩理由。

On the Writing of Administrative Reconsideration Pleading

With the Administrative Reconsideration Law being put in force and the Administra- tive Reconsideration Article being abrogated, there have been many changes in the writing meth- ods and demands of administrative reconsideration pleading. The distinction lies in the following aspects: (i) The prerequisite factors of the writing are not alike; (ii) Whether it is a necessary document ; (iii) The legal responsibility is not the same; (iv) The pleading reasons are different from that of the trial of the first instance, the refutable ways are mainly used in the document.
