摘    要:我国《劳动合同法》的立法价值目标是实现劳动关系的和谐。但在《劳动合同法》的实施过程中,企业的抵制、规避行为,配套法规和规章制度的不健全以及地方政府、工会未能发挥应有作用导致《劳动合同法》的实施效果不容乐观。为此,要建立企业社会责任制度,促进企业自觉维护职工权益,并完善《劳动合同法》的相关配套制度,落实政府与工会在保护劳动者权益方面的积极作用。
