| 摘 要： | 对贪污罪适用死刑违背了刑罚的公正性,侵犯了罪犯的人格,实践中也收不到预防犯罪的良好效果,但就我国现阶段所处的条件而言,又不宜立即予以废除,因此我们只能采取先从技术上严格控制直至最后完全废除的刑事政策。

| Abstract: | The death penalty to corruption offense violate the justice of penalty infringe on personalityof the offender,can't guard against the corruption in practice.However.it is not appropriate to abolish it,considcring the conditions of our country today.So we have to adopt to the policy of abolishing gradually thedeath penalty to corruption offense. |
