中国近代法理学的形成与发展

法理学在中国近代社会的形成、发展与西学的传入、近代中国社会的特征密切相关。法理学西来并逐渐发展之日，正是传统法律在中国解体并断裂之时。近代中国的法理学是在批判传统、吸纳西学中形成的，所以其少有传统的因素。但随着社会的发展，新兴的法理学逐渐开始了与传统的结合，思想家们对传统法理也有了一定程度的肯定，并努力探索着中西法理的融合之路。
