诱惑侦查之方法论解读

对于诱惑侦查,不能只从诉讼视角展开,还应该从方法论角度予以关注。诱惑侦查的范围包括“犯意诱发型”和“机会提供型”两种情形,其目的是为了查明案件事实、收集证据和查获作案人,其侦查途径为从案到人和从人到案的合并使用,即根据案件情况或者线索情报确定作案人的特征和嫌疑范围,然后运用诱惑手段寻找、确定嫌疑人,从而破获案件。诱惑侦查的策略手段具有高效性、欺骗性和是否合法的模糊性,因此,对其规范时应从使用时机、适用范围、适用程序、适用对象和行为方式等方面综合考虑。
