| 摘 要： | 船舶融资租赁合同纠纷案件的审判和实体法律适用存在误区。我国《海商法》未就该类合同作出明确的立法规定,我国《合同法》确立了适用法律的框架,但其与我国《海商法》、《金融租赁公司管理办法》等金融法律法规的衔接以及该类合同在实践中的变异性等问题,在海事审判中把握不易,值得研究。

| Abstract: | Case of shipping finance lease contract can not avoid certain misinterpretations in the process of trial and application of law. Although shipping finance lease contract is not specified in Maritime Code of PRC, the framework of its application of law is formulated by Contract Law of PRC. Nevertheless, it's difficult to harmonize its relationship with other laws and regulations including Maritime Code of PRC and Regulations on the Management of Finance Lease Company and manipulate its variance in legal practice, which is a subject worth a conscientious study. |
