对我国商业银行个人理财业务法律制度的检讨与反思

法律的功利性决定了任何法律制度的创建都必须恪守从社会中来到社会中去的实证法则。然而，若对务实层面的关注是以牺牲或淡化法律的形式性与逻辑性要求为代价，那么就是一种彻底的对“法律的生命不在逻辑，而在于经验”及法治下正义的误读。虽然我国快餐性的商业银行个人理财法律制度缓解了风险防范与秩序构建中的迫切性要求，但是个中所流露出的一些缺憾仍值得我们审视与反思。
