| 摘 要： | 刑事鉴定意见具有专业性和科学性,会对案件的审理结果产生实质影响。刑事鉴定意见的庭前开示程序对于保障辩护权、诉讼效率以及监督鉴定机构和鉴定人具有重要作用。由于披露内容有限、未规定法院对庭前开示的组织权、救济措施缺失等问题,刑事鉴定意见往往缺乏有效的质证。只有明确鉴定意见开示的启动、扩大鉴定意见开示的内容、规范鉴定意见开示的方式等,才能完善刑事鉴定意见的庭前开示程序。

| Abstract: | Criminal appraisal opinions are professional and scientific documents and may have substantive influence on trial results.The pretrial publication procedure of criminal appraisal opinions plays an important role in the protection of the right to defense,guarantee of litigation efficiency and supervision on appraisal institutions and experts.Criminal appraisal opinions are often not effectively cross-examined due to limited disclosure of the content,lack of right by courts to organize pretrial publication procedure,and short of remedial measures.Therefore,we should improve the pretrial publication procedure of criminal appraisal opinions by making clear the right to initiate publication,expanding the content to be published and standardizing ways of publication. |
