贿赂犯罪缓刑、免刑适用率高的原因与对策

目前,我国贿赂犯罪的缓刑、免刑适用率一直偏高,这不仅使刑罚的一般威慑功能大为减弱,而且不符合我国从严治吏的政策要求。造成这一现象的主要原因是司法人员对于宽严相济刑事政策的内涵理解不当及法官的自由裁量权过大。为此,应当采取纠正司法人员的执法观念、制定量刑指导意见、加强刑事裁判文书的量刑论证、赋予公诉机关量刑建议权等对策。

Cause and countermeasures for the high rate of probation or pardon in bribery

At present,the application rate of probation or pardon in bribery has been high,which not only significantly weaken the general deterrence of the penalty,but also is not in line with our strict policy requirements.The main reason for this phenomenon is the judiciary＇s improper understanding of the content of the criminal policy and the judge＇s too much discretion.So,we should take measures to correct the concept of judicial enforcement, to develop sentencing guidance,to strengthen sentencing argument for criminal judgement,and to give the right of sentencing recommendation to public prosecution.
