论我国罪刑法定原则下的法官刑事自由裁量权

罪刑法定原则在我国刑法中的最终确立符合了现代文明社会在刑事立法和刑事司法领域的发展趋势。它不仅是人权保障制度的重要组成部分,亦是社会文明进步的标志。然而在司法活动过程中,严格遵循罪刑法定原则的关键是如何认识和处理罪刑法定与司法裁量之间的关系。司法机关对被告人是否定罪,对犯罪人应判处何种刑罚,均应严格遵循刑法的规定,严禁法外定罪和法外量刑,这是罪刑法定原则对刑事司法的最基本要求。但是,法律的实施离不开人的因素。司法裁量权作为司法权的一种,它对于案件的正确处理是十分必要的,法官在刑事审判中正当地行使自由裁量权,按照社会发展的需要补充以新的内容,使法律与社会同步渐进地发展,从而既可以避免突变性立法,又可避免不必要的社会震荡和阻碍经济发展。可见,在司法活动中,法官的能动作用是保证法律正确实施的重要因素。本文即从这个角度出发来阐述我国罪刑法定原则下的法官刑事自由裁量权。

On the criminal discretion of the judges under the principle of legality

The final establishment of the principle of legality in the Criminal Law of China accorded with the development of the modern civilized society in the criminal legislation and the field of criminal justice.It is not only an important component of the protection system of human rights but also a sign of social progress of civilization.However,in the course of judicial activities,the key to strictly observe the principle of legality is how to understand and deal with legality and the relationship between judicial discretion.Whether the conviction of the accused,the judiciary,the offender shall be sentenced to penalties,should strictly follow the provisions of the Penal Code. The conviction and extrajudicial punishment is the principle of legality of the most basic requirements of criminal justice.However,the implementation of the law can not be separated from the human factor.Judicial discretion of the judicial power as a form of it for the correct handling of cases is very necessary,the judge in the criminal trial of the local discretion,in accordance with the needs of social development to add new content,to make legal and social synchronous progressive development, thus avoiding both mutations legislation, while seeking to avoid unnecessary social shocks and hamper economic development.We can see that in judicial activities,the dynamic role of the judge is an important factor to ensure correct implementation of the law.This article expounded the criminal discretion of the judges under China's principle of legality from this perspective.
