立法民主化与公正化的整合——解析重庆市首次立法听证会

2002年9月5日,重庆市人大常委会法制委就全国第一个委托律师事务所起草的法规草案《重庆市物业管理条例(草案)》举行了首次立法听证会。虽然在我国立法听证还没有发展为一项立法的基本制度和必经程序,尚处于探索阶段,但由于各方面准备充分,听证事项集中,保证了听证参与人的针对性、专业性强,整个听证程序规范、公正,为立法民主化、科学化进行了一些突破性、创新性的探索,取得了较好的实效。与此同时,听证事项的复杂性和程序的探索性都使得此次听证会在很多方面显得"心有余而力不足",还存在许多制度设计上的问题,需要我们进一步完善听证程序,使之逐步规范化、民主化、科学化,从而切实保障人民的切身利益,实现立法目标。

Report on the First Legislative Hearing of Chongqing Municipal City

The Legal Committee of Chongqing People's Congress standing council held its first legislative hearing on the draft of regulations on management of real estate, the draft of which was firstly delegated to a law firm in China, on Sept. 5th, 2002. Legislative hearing, however, has not been well developed into a regulated system in china and most of its rules not been established. Nonetheless this hearing, as a probing and experimenting step with some initial and breaking through characteristics, has resulted effectively and positively. Meanwhile, it also revealed that only when legal rules of legislative hearing are nationwide established could some critical issues be resolved properly.
