变迁中的民间社会及民间法之命运

民间社会是一个以地域和权利为纽带，具有自己独立的内在运行逻辑和规则的自治体，民间法作为一种社会秩序，虽然它的形成和发展不能不受到国家正式法律制度的影响，但它是在国家法以外自发生成的规则体系，是民众自己而不是国家机关意志的外化形式，它出自“民间”，反应现代民间社会的需求。从现代民间社会自身的建设看，必须依照现代市场规则的要求整合民间法资源；民间法还应当建立起向国家法主动输送制定法“半成品”的机制。
