韩国检察制度简介（上）

韩国通过日本继承了德国的检察制度,共经历了五个时期.韩国的检察权具有司法权和行政权的双重属性.采取起诉独占主义和起诉便宜主义,奉行严格的追诉标准.韩国检察权的内容广泛,包括:对法院正确适用法律的请求权、执行裁判的指挥监督权等多项权力.检事是侦查的主宰者,具有准司法机关性、独立性和身份保障的法定性.

Brief Introduction to the Procuratorial System of Korea (I)

Korea has succeeded to the German procuratorial system via Japan,and experienced five epochs.Korean procuratorial power has double natures of judicial power and administrative power,and the principles of exclusiveness and opportunity of pros- ecution and strict criterion of accusation are adopted.Korean procuratorial power has aboard contents including but not limited to the right request the court correctly applying the law and the power of command and supervision of execution of the judgments. The prosecutor is the leader of investigation who has character of quasi-judicial organ,independence and statutory status.There are many characteristics within the category,organization and personnel structure of Korean procuratorate.
