| 摘 要： | 现代社会的显著特征是多元化。在法律领域,我们不能说国家法完全不能适应现代社会的多元化发展趋势,但是它所能涉及到的社会关系、所能涵盖的社会内容毕竟是有限的、片面的,需要不同层次、具有不同效力的规则来调整不同的社会关系,以适应社会关系的变化与社会主体的需求。这就必然为民间法提供了存在的空间。民间法在现代社会的存在必然有其合理性。

| Abstract: | Diversity is the most outstanding characteristic of modem society. In the law field, we can not say that state law not suit the trend of diversity. But the content of the state law is limited and one - sided. This condition need different rules which have different efficiency regulate the society, keep abreast of the society and satisfy the needs of the people. As a result, the nongovernmental law can exist in some fields, and it must have some rationality. |
