中国法制现代化几个问题的思考

法制现代化是社会主义现代化建设的重要组成部分,也是依法治国的必然要求。中国的封建法律文化、中国革命中形成的革命法律思想与司法体制、新中国成立后长期的计划经济都是法制现代化的障碍。要完成中国的法制现代化,必须首先树立现代法律意识和法制观念,建设社会主义物质文明、政治文明和精神文明,作为法制现代化的基础工程,推进政治体制和司法体制改革,建立现代化的法津运行机制,形成以民商法为重心的反映现代化的法律体系,并吸收和借鉴西方发达资本主义国家的法制文明,加快中国法制现代化的步伐,使法制现代化的变革运动成为社会主义现代化的源动力之一。

On the Modernization of Chinese Legal System

The modernization of legal system is an important component of the modernization construction of socialist as well as an inevitable requirement of rule by law. The modernization of legal system has been hindered by feudal legal culture , revolutionary legal ideas and judicial system formed during Chinese revolution and long ?term planned economy after the founding of the PRC. Hence, to fulfill the modernization of legal system, the following is necessary: to set up modern consciousness and idea of legal system; to construct the material, political and spiritual civilization of socialism as a basic project of legal system modernization; to advance the reform of political system and judicial system; to establish the operating system of modern law; to form legal system revolved around the Civil and Commercial Law, reflecting modernization ; to absorb and use the legal civilization of developed capitalist countries; to quicken the modernization pace of Chinese legal system; to make the transformation campaign of modernizing legal system one of the source of socialist modernization .
