“办案情况说明”证据能力探讨

“办案情况说明”不是规范的专业术语，只是一种概括的说法。在我国司法实践中，应法院、检察院的要求，由公安机关出具的情况说明形形色色。并非所有的“办案情况说明”都具有证据性质。具有证据性质的“办案情况说明”可以分为三类：证据补充性“办案情况说明”、证明侦查行为合法的“办案情况说明”和直接对定罪量刑有影响的“办案情况说明”。各类“办案情况说明”的证据能力各不相同，应区别对待。当前，法庭采信部分“办案情况说明”存在现实弊端。
