入世后中国刑法的调整与更新

为适应入世的要求,作为国家一项基本法律的刑法,也必须要从基本的价值理念到具体的制度,作一个全面的调整与变革。具体地说,在价值取向上,刑法的人权保障机能应成为刑法的优先选择价值。在刑事政策上,正确处理犯罪化与非犯罪化的关系,科学划定犯罪圈;更新刑事处罚理念;以行刑社会化为指导,重构行刑模式。此外,在犯罪主体、犯罪类型及刑法条文结构等方面也要作相应的调整。

Adjustment and Renewal of the Criminal Law of PRC after the Entry into the WTO

In order to keep abreast of our entry into the WTO,the criminal law,as a foundamental law of our country,should be adjusted and reforme d in an all-round way from its values to concrete regulations.In value orientati on,the criminal law should give priority to pro-tection of the human rights;In criminal policies,it' s necessary to handle the relations between criminality a nd non-criminality,scien-tifically delimit the circle of crimes,renew the ideas of criminal punishment,and rebuild the mode of executing punishment.In addition ,some respects such as subjects and types of crime,the structure of the criminal articles should be adjusted correspondingly.
