媒体报道与司法公正关系的反思与再构

媒体对司法活动的报道有助于实现司法公正并防止司法独立走向司法专横。司法可以强制当事人履行其裁判结果,但不应限制当事人及其他民众通过媒体对其公正性表示质疑;对媒体报道反映的当事人及其他民众的观点,任何人都可以不赞同,但人们必须尊重和捍卫他人说话的权利。

Reflection on the relation between media coverage and judicial impartiality

Media's coverage on judicial affairs is helpful to fulfillment of judicial impartiality, and will prevent judicial autonomy from any despotism. Although the person concerned with can be forced to fulfill the judicial result in jurisdiction, the freedom for the person concerned with or other people to express his doubt on the impartiality of such a jurisdiction by means of any media should not be limited. In regard to the views of the person concerned with and other people, you may not agree with them, but should at least respect and even protect such a right for speaking.
