| Abstract: | The principle that obedience to the order of a superior officer will not prevent a soldier from punishment is one of the basic principles in the international criminal law.This article tries to analyse several conceptions concerning with this principle,such as evidently illegal order,moral choice,threat and so on,so as to have this principle applied to the judicial practice more sufficiently and correctly. |
