| 摘 要： | 刑事诉讼程序要体现公正、秩序和效率三大价值,死刑复核程序也不例外。但现行死刑复核程序在三大价值的体现方面均有所缺失且未能很好地实现三大价值的权衡。因此,对正在进行改革的死刑复核程序从价值的角度进行分析是必要的。

| Abstract: | The criminal prosecution procedure must manifest the values of fair,order and efficiency,and the death penalty review procedure is not exceptional.But the present death penalty review procedure manifests the aspect in three great values to have a flaw,has not yet been able to realize three great values measuring well.Therefore,the analysis regarding to the reforming of the death penalty review procedure is necessary on the value angle. |
