交通肇事逃逸的事故责任确定及其应用

我国现行法律对交通肇事逃逸的事故责任确定采取的是推定责任的方法。在公安实践中推定责任的具体做法有“加一档法”和“减一档法”，这两种不同的方法对同一起肇事逃逸的交通事故所推定的事故责任可能会相差很大，且推定的事故责任虽然可以直接作为民事诉讼中的证据，但不能直接作为刑事诉讼中的证据使用。因此，对于事故原因可以查清、责任能够做出明确认定的交通肇事逃逸案件，宜采用认定责任的方法，相关的法律也应当做出相应修订。
