信息网络传播权探究

2001年《著作权法》的修改以及2006年《信息网络传播权保护条例》的颁布,为我国信息网络传播权的保护提供了明确的法律依据,但是这些立法还有需要完善的地方。笔者建议,要根据信息网络传播权的特点,对我国的现存相关立法进行修改完善：一是在立法中增加对信息网络传播权保护的原则性条款;二是对信息网络传播权进行重新阐释;三是应扩大法定许可的范围;四是对某些作品的使用设立默示许可;五是更加合理地确定侵权的赔偿数额。

Inquiring Information Network Transmission Right

The amendment of ＂Copyright Law＂ in 2001 and the promulgation of ＂Information Network Protection Ordinance＂ in 2006 provide a clear legal basis for the Protection of China＇s information network right,but the legislation still need to be perfected.I suggest,according to the characteristics of information network transmission right,to revise and improve China＇s existing relevant legislation： f irst,increase principle terms for Protection of Information Network Transmission Right in the Legislative;second,re-interpret the right to network dissemination of information;third,the scope of the statutory license should be expanded;fourth,establish implied license to the use of certain works;fi fth,more reasonably determine the amount of compensation for infringement.
