| 摘 要： | 本文从法治价值、历史经验和规范分析三个层面分析了司法审查（尤其是普通法院司法审查）在中国面临的处境，最后在社会动力和逻辑价值吻合的角度上给出自己的“决断”：选择一种“最低限度的司法审查”的规范解释进路。

| Abstract: | This article give analysis of the situation of judicial review （especially the ordinary courts of judicial review） in China from three levels, the value of rule of law, historical experiences and standard analysis, and finally give his own ＂decision＂ which match the social dynamics and logic value： to choose a normative interpretation road of a＂ minimum level of judicial review＂. |
